Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of HHA Data, operated by Auriflow Digital LLC ("Company," "we," "us"). By accessing hhadata.com or subscribing to any plan, you agree to these Terms. If you do not agree, do not use the service.

2. The Service

HHA Data provides access to Medicare home health agency information sourced from the Centers for Medicare & Medicaid Services (CMS). The service includes:

  • Searchable database of 12,000+ Medicare-certified home health agencies
  • CMS star ratings, survey history, and deficiency records
  • Contact information and ownership data
  • Data export (CSV/JSON) and API access depending on subscription tier

We are not affiliated with Medicare, CMS, or any government agency. Agency data is sourced from public CMS datasets and may not reflect the most recent changes.

3. Subscriptions and Billing

  • Subscriptions are billed monthly in advance.
  • All fees are in US dollars and are non-refundable except as described in Section 4.
  • We use Stripe for payment processing. By subscribing, you authorize recurring charges.
  • If a payment fails, we may suspend access until payment is resolved.
  • Prices may change with 30 days' advance notice to existing subscribers.

4. Cancellation and Refunds

You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period — you retain access through that date.

Refunds are issued at our discretion. If you experience a technical issue that prevents you from accessing the service and we cannot resolve it within 3 business days, you are entitled to a prorated refund for that period. Contact support@hhadata.com to request a refund.

5. Permitted Use

Your subscription grants you a limited, non-exclusive, non-transferable license to:

  • Access the platform for your own internal business purposes
  • Export and use data within the limits of your subscription tier

You may not:

  • Resell, sublicense, or redistribute access to the platform or data
  • Use automated scraping, bots, or crawlers against the platform
  • Share login credentials with third parties outside your organization
  • Use the data to build a competing data product or service
  • Reverse-engineer or attempt to extract the full database through the API beyond your tier limits

6. Data Accuracy Disclaimer

Data is sourced from CMS public records and updated monthly. We make reasonable efforts to maintain accuracy but cannot guarantee that all records are current or error-free. HHA Data is provided for informational and research purposes only — it is not legal, medical, or financial advice. Always verify critical information with the agency directly or through CMS.gov.

7. Intellectual Property

The HHA Data platform, including its design, software, and compilation of data, is owned by Auriflow Digital LLC. The underlying agency data is sourced from public government records. Your subscription does not grant you ownership of any part of the platform.

8. Limitation of Liability

To the maximum extent permitted by law, Auriflow Digital LLC will not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of HHA Data. Our total liability to you for any claim is limited to the fees you paid in the 3 months preceding the claim.

9. Termination

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if required by law. If we terminate your account without cause, we will refund any prepaid fees for the unused portion of your subscription.

10. Governing Law

These Terms are governed by the laws of the State of Minnesota, USA, without regard to its conflict of law provisions. Any disputes will be resolved in the courts of Hennepin County, Minnesota.

11. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated to active subscribers by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
